EB-5 Investor Green Card 2026: Complete Guide ($800K Investment)

    By TravelReady Team•May 22, 2026•15 min read

The EB-5 Immigrant Investor Program offers a direct path to US permanent residence for investors who invest $800,000 or $1.05 million in a US business. It's the "Golden Visa" of the United States.

    Regional Center vs. Direct Investment

Most investors choose Regional Centers (passive investment). We explain the pros and cons of both.

    What is the EB-5 Visa?

The EB-5 program was created to stimulate the US economy through job creation and capital investment. It allows foreign investors to obtain Green Cards for themselves, their spouse, and unmarried children under 21.

    Investment Amounts (2026 RIA Standards)

The investment amount depends on where the business is located:

Targeted Employment Area (TEA) - $800,000

Rural areas or areas with high unemployment (1.5x national average).

90% of EB-5 investments are in TEAs because of the lower investment threshold.

    Non-TEA - $1,050,000

Any other location in the United States.

    Requirements

    • Capital Investment: $800K or $1.05M of your own money.
    • Source of Funds: Must prove funds were obtained lawfully (salary, sale of property, gift, inheritance, loan).
    • Job Creation: Must create 10 full-time jobs for US workers within 2 years.
    • At Risk: Capital must be "at risk" (no guarantees of return).

    Application Process

    1

    Choose a Project

Select a Regional Center project or start your own business. Due diligence is critical here.

    2

    Invest Capital

Transfer the $800K or $1.05M to the project's escrow account.

    3

    File Form I-526E

Immigrant Petition by Regional Center Investor. Prove source of funds.

    Filing fee: $11,160

    4

Consular Processing or Adjustment of Status

Once your I-526E is approved, two pathways exist. Consular processing (DS-260) takes place at a US embassy or consulate abroad. Adjustment of Status (I-485) allows qualifying applicants to finalize their green card from within the US. Under USCIS policy memo PM-602-0199 (May 2026), I-485 faces heightened discretionary scrutiny, but USCIS clarified the same week that the policy is case-by-case, and filings remain accepted. EB-5 investors, whose capital provides direct US economic benefit, are generally well-positioned for favorable discretionary treatment. Consult an immigration attorney to choose the right path for your situation.

    5

    Conditional Green Card (2 Years)

You get a 2-year green card. You can live and work in the US.

    6

    File Form I-829

Petition to Remove Conditions. Prove that jobs were created and money stayed invested.

    Filing fee: $9,525

    ✓

    Permanent Green Card

Conditions removed. You are a permanent resident. Return of capital usually happens around this time.

    Costs Breakdown

Does your case trigger the EB-5 risk patterns?

Knowing the failure modes is not the same as knowing whether they apply to your documents. Officer's Read cross-references your specific employment letter, bank statement, and cover letter against current EB-5 embassy rules, the way an officer would, and flags what would be questioned before you submit.

What we check that this guide can't:

    • →Whether your source-of-funds documentation would survive USCIS's lawful-source-and-path scrutiny
    • →Whether your job-creation methodology and business plan hold up to an economist-level review
    • →Whether your TEA (targeted employment area) designation is correctly documented

A New York federal court struck down the 75-country freeze, the department says it withdrew the freeze instructions and its posts are processing those cases again, and the government has appealed. On 17 July 2026 DHS published a rule to replace "duration of status" for F-1 and J-1 students with a fixed admission of up to four years from 15 September 2026. On 14 September a federal court in Massachusetts postponed it, so duration of status still applies while the government appeals. Here is where the case stands, what the rule would change if it takes effect (the Form I-539 extension step, a shorter period to leave, OPT), and the other 2026 shifts students should know: online vetting, the $250 Visa Integrity Fee, and a drop in new visas.
